During the annual meeting of the Council for Civil Society and Human Rights (HRC) with the participation of Russian President Vladimir Putin, one of the topics was the regulation and protection of personal data. This topic was the subject of the speech of the member of the HRC, Chairman of the public organization "National Anti-Corruption Committee" Kirill Kabanov. He spoke about the danger of treating data as property accumulated by business, and recalled a series of high-profile incidents this year, including leaks in "Yandex.Food" and the "Gemotest" laboratory network. At the same time, the perpetrators got off with minor fines.

Gemotest representatives acknowledged the fact of the leak, but stated that they were not guilty due to the lack of intent. The defence stated that they would challenge the verdict in the prescribed manner.
"In this regard, it seems appropriate to establish higher turnover fines, primarily for companies that have leaked personal data. This will ensure the protection of personal data and will stimulate businesses to strengthen security," Kirill Kabanov proposed. "But turnover fines alone will not solve the problem. It is necessary to introduce criminal liability for the illegal circulation of personal data. Since in most cases we are not talking about just accidental leaks - this is either theft or some kind of deliberate theft within the company." Kirill Kabanov also called for not starting work on any projects where all possible risks associated with personal data leaks have not been eliminated.
The President agreed with the proposals: "Everything that is not regulated needs additional regulation. And probably there is a need to tighten the liability for violations in this area. As for turnover fines and criminal liability. Those who use this data must know and understand that they are using stolen data - that's right, because even the property that is stolen, if it is a bona fide purchaser, a bona fide buyer of this or that property, he does not know that it is stolen goods. By analogy, the same thing here ... Turnover fines - of course, we need to think about this. But, of course, I will emphasize once again, you are right that the appropriate decisions must be worked out and made to protect the interests of citizens." Vladimir Putin promised to prepare the appropriate instructions for the Ministry of Internal Affairs, the Ministry of Digital Development, and the Bank of Russia.
